What happens during pre-trial conference? #
- Frame contested and uncontested issues in the petition.
- Consider consolidation of petitions in cases where more than one petition is filed.
- The 2022 Presidential petition had 9 separate petitions, of which all but one challenged the 2022 election results as declared by IEBC on 15th August 2022.
- Determine the number of advocates that the court shall hear on behalf of each party.
- Each of the main parties in the 2022 Presidential Petition (Raila Odinga and William Ruto) has at least 50 lawyers acting for them. Not to forget that the IEBC has engaged two separate teams of lawyers to represent the two camps that emerged within the commission before the elections and played out in public during declaration of results.
